Section A – Introduction

 

If you are a paid up REPTA member aged between 16 and 79 years you are

automatically entitled to the cover provided by this policy. If you cease to be a

member of REPTA all cover under this policy will cease with immediate effect.

 

Subject to the above this policy is valid from 1st January 2010 until 31st December 2010.

 

 

Section B – Important Information

 

Our Contract with You

 

This policy is a contract between you and us. Under the terms of this policy, we will

pay the benefits described in the ‘What is covered’ section if you suffer accidental

bodily injury whilst cover is in force.

 

Please read this policy carefully and make sure you know what this insurance does

and does not cover.

 

Choice of Law

 

The law of England and Wales will apply to this contract unless:

  • We agree with you otherwise; or
  • At the date of the contract you are a resident of (or, in the case of a business,
  • the registered office or principal place of business is situated in) Scotland,
  • Northern Ireland, Channel Islands or the Isle of Man, in which case
  • (in the absence of agreement to the contrary) the law of that country will apply.

 

Use of Language

 

Unless otherwise agreed, the contractual terms and conditions and other information

relating to this contract will be in English.

 

Our Promise of Service

 

Our goal is to give excellent service to all our customers but we recognise that

things do go wrong occasionally.  We take all complaints we receive seriously and

aim to resolve all our customers’ problems promptly.  To ensure that we provide the

kind of service you expect we welcome your feedback.  We will record and analyse

your comments to make sure we continually improve the service we offer.

 

What will happen if you complain?                   

We will acknowledge your complaint promptly

We aim to resolve complaints, following assessment and investigation, as

quickly as possible.

 

Most of our customers’ concerns can be resolved quickly but occasionally more

detailed enquiries are needed.  If this is likely, we will contact you with an update

and give you an expected date of response. 

 

What to do if you are dissatisfied

If you are disappointed with any aspect of the handling of your insurance we would

encourage you, in the first instance, to contact the General Secretary of REPTA,

as shown in your REPTA handbook.

 

If you remain unhappy with the decision you receive, you may write to the Chief

Executive of Aviva. 

If you are dissatisfied with our final decision (from the Chief Executive Officer),

you can refer the matter to the Financial Ombudsman Service (FOS).

Full contact details of both our Chief Executive and the FOS will be provided

when we write in response to your complaint. 

Whilst we are bound by the decision of the FOS, you are not. Following the

complaints procedure does not affect your right to take legal action.

 

Financial Services Compensation Scheme

 

We are members of the Financial Services Compensation Scheme (FSCS).

You may be entitled to compensation from this scheme if we cannot meet our

obligations, depending on the type of insurance and the circumstances of your claim.

Section C - Definition of terms

 

Accidental bodily injury

Bodily injury resulting solely and directly from accidental outward violent and visible

means which, within 12 months of the date of the accident, shall solely and

independently of any other cause, result in death or disablement. It does not include

sickness or disease or treatment for sickness or disease as a result of the accident,

degenerative condition, naturally occurring condition, medical disorder or the result

of any gradually operating cause.

 

Legal personal representative (death arising from accidental bodily injury)

The person who you nominate to represent your interests in the event of your death.

 

Passenger

Using scheduled public transport not in performance of your occupation as a

railway or coach employee.

 

Period of insurance

1st January 2010 until 31st December 2010.

 

Permanent total disablement

Means permanent and total disablement (other than loss of sight or limbs) which

prevents you from following any and every occupation which lasts for more than

12 months from the date of the accident, and in all probability shall continue for the

remainder of your life.   

 

Scheduled public transport

Scheduled train, bus, ship, ferry, hovercraft or fully licensed passenger carrying

aircraft forming part of a registered commercial airline.

 

Temporary total disablement

Means temporary and total disablement (other than loss of sight or limbs) which

prevents you from following any and every occupation.

You, your, yours

The insured person who:

• is aged between 16 and 79 years of age

• is a paid up member of REPTA at the time of the event.

 

 

Section D - What is covered

 

We will pay you or your legal personal representative(s) the amount shown in

the Table of Benefits shown in Section E should you suffer an accidental bodily

injury resulting from an event listed below during the period of insurance which

is the sole cause of and results in your:

  • death;
  • total and permanent loss of sight in one or both eyes;
  • permanent loss by physical severance of a hand or foot at or above the wrist or ankle;
  • permanent total disablement or temporary total disablement within 12
  • months of the injury from which the claim arises.
 

You cannot transfer this insurance to any other person.

 

Event A

An accident directly involving scheduled public transport in which you are travelling

as a passenger within Europe. 

 

Event B

An accident directly involving scheduled public transport in which you are travelling

in performance of your occupation as a railway or coach employee within Great Britain,

Northern Ireland, the Channel Islands or the Isle of Man.

 

Event C

An accident on any railway platform or in any coach or bus garage within Great Britain,

Northern Ireland the Channel Islands or Isle of Man.

 

Event D

An accident occurring in the performance of your occupation as a railway or coach

employee arising out of:

you being accidentally knocked down by a horse, cycle or vehicle whilst a pedestrian

on a public highway; or

an accidental  bodily injury sustained whilst pedal cycling by direct route from

your home to your place of  work or vice versa within Great Britain, Northern Ireland,

the Channel Islands or the Isle of Man

 

 

Section E - Table of Benefits

 

Accidental bodily injury resulting in the following:                                                    

 

Event  A

 

• Death                                                                                                           £12,000

• Permanent total loss of sight in both eyes                                                       £12,000

• Loss of two or more limbs by actual severance at or above the wrist or ankle      £12,000

• Permanent total loss of sight in one eye and loss as defined above of one limb   £12,000

• Loss as defined above of one limb                                                                   £ 6,000  

• Permanent loss of sight in one eye                                                                   £ 6,000

Permanent total disablement or temporary total disablement                 £53 per                                                                                     week*
 
*to a maximum of £12000

 

Events B, C & D

 

• Death                                                                                                        £3,000

 

 

 

When will the insurance and benefits end?

 

All cover provided by this insurance and all benefit payments will end on one

of the following dates:

• the day before your 80th birthday

• the day you cease to be a member of REPTA

• the day we cancel this insurance by giving you 30 days’ written notice

• the day you make a fraudulent claim (if this happens, your insurance cover will end, you

will have to return any insurance benefits we have paid and you will not receive any further

benefits)

• the day we pay to you or your legal personal representative total of £12,000

for any one or more events.

 

 

Section F - How to make a claim

 

Death arising from accidental bodily injury

For your legal personal representative(s)

 

Contact the REPTA General Secretary as shown in the REPTA handbook.

You may be sent a claim form that you should fill in and send back to us as soon

as possible with any evidence we ask for. The claim form includes a report for the

deceased’s doctor or consultant to fill in.

 

We may not be liable for the claim unless we receive the claim form within 180 days

of the event you are claiming for.

 

Accidental bodily injury

 

Contact the REPTA General Secretary as shown in the REPTA handbook.

You may be sent a claim form which you should fill in and send back to us as soon

as possible with any evidence we ask for. The claim form includes a report for your

own doctor or consultant to fill in.

 

We may not be liable for your claim unless we receive your claim form within 180

days of the event you are claiming for.

 

• When you make a claim, you must provide and pay for any proof we ask you for.

• If we ask you to go for a medical examination, we will pay the doctor’s fee.

• If you suffer a bodily injury, you must see a doctor and follow his or her advice.

 

 

Section G - General Exclusions

 

What is not covered:

 

We will not pay any claim arising directly or indirectly from the following:

• any disability due to a gradually operating cause or any naturally occurring condition

or degenerative process

• a criminal act committed by you

• suicide or intentional self-inflicted injury

• alcohol or drugs taken by you (except drugs taken under medical supervision

but not for the treatment of drug addiction)

• getting on, getting off or falling from scheduled public transport

• flying as a pilot of an aircraft

• engaging in Military, Army, Naval or Air service operations

• any consequence whatsoever resulting directly or indirectly from or in connection

with terrorism

• any consequence whatsoever resulting directly or indirectly from or in connection

with any of the following, regardless of any other contributing cause or event: war,

invasion, act of foreign enemy, hostilities or a warlike operation or operations

(whether war be declared or not), civil war, rebellion, revolution, insurrection, civil

commotion assuming the proportions of or amounting to an uprising, military or

usurped power

• ionising radiation or radioactive contamination from nuclear waste or the radioactive,

toxic explosive or other dangerous properties of explosive nuclear equipment

 

 

Section H - General Conditions

 

1. Your duty to comply with the conditions

Without prejudice to our rights, we will only be liable to make any payment under

this policy if you have at all times complied with the terms, and conditions of this policy.

 

2. Age Limits

No cover will apply if you are under 16 years of age and all cover will cease the

day before your 80th birthday.

 

3. Trust, Charge of Transfer

Payment for accidental death benefit may be subject to Inheritance Tax.

We will not enter into or be bound to accept or be affected by any notice of any trust,

charge, transfer or other arrangement and will pay any claim to your legal personal

representative only.

 

4. Fraud

If you, or anyone acting for you, makes a claim under this policy knowing the claim

to be dishonest or intentionally exaggerated or fraudulent in any way, or if you give

any false declaration or statement to support the claim we will not pay the claim and

all cover under the policy will end.

 

We reserve the right to tell the police about any dishonest claim.

 

5. Cancellation

As this cover is provided as part of Your REPTA membership there are no statutory

cancellation rights provided under this policy.  We may cancel this policy by sending

30 days notice to REPTA.
